01 Who and what
Voltane is a Borderline Games game, published by Maxime MONTEIRO, entrepreneur individuel (sole trader) trading as Borderline Agency, 693 Avenue Pierre Lacans, 34310 Montady, France, SIRET 825 031 529 00019. Contact: [email protected]. All the details are in the legal notice.
These terms apply to the game, the website and the Paddock. Creating an account, playing or buying means accepting them. How your data is handled is described in the privacy policy.
02 The game and your account
Voltane is free, with no ads, and plays in a web browser. An account (driver name, email, password) is used to play, solo and online alike, to keep your progress and to sign in to the website: it is the same account everywhere.
One account per person. Your password is for you alone: anything done from your account is deemed to have been done by you. If you think someone else is using it, change it and write to us.
You can delete your account whenever you like, from Settings › Account.
03 Age
Voltane is open to everyone. Under 15, a parent’s consent is needed to create an account, and under 18, for any purchase. Nothing in the shop is needed to play.
04 Good conduct
Driver names must stay decent. No insults, harassment or hate speech, whether in a driver name, in the Paddock or anywhere else.
No cheating: no tools, scripts, bots or tricks to get around the server or to rig a race, a record or a reward. A flaw you find gets reported, not exploited.
Every driver can report another driver or a message, and block a driver. The team reviews reports.
In the event of a breach, once reported or observed, the team may remove a driver name, hide a profile, cancel a result or winnings obtained by cheating, suspend posting in the Paddock, or close the account in serious or repeated cases. The driver concerned is notified, with the reason, and may reply to [email protected].
05 The Paddock
The Paddock is Voltane’s forum. Anyone can read it; posting requires a game account with a confirmed email address. Every driver is responsible for what they post.
The rules: no insults, harassment or hate speech; no cheating, and no tools or tricks to get around the server; no advertising or dubious links; no personal information, yours or anyone else’s.
The “Report” button alerts the team (spam, insult, cheating or other, with an optional note). The Voltane team and the moderators it appoints may pin, lock, move, rename, delete or restore a post or a thread, and suspend posting in the Paddock for 1, 3, 7 or 30 days, or permanently. The game stays playable. Every moderation action is recorded in an internal log.
To fight spam: one post every 15 seconds, one thread every 2 minutes. An account less than 24 hours old cannot post links, or more than 3 posts an hour.
By posting, you allow Voltane to display your post in the Paddock for as long as it stays there. If you delete your account, your posts stay in place, signed “a former driver”.
06 Progress and bolts
Progress (levels, Voltage, bolts, crates, cars, tuning, decorations) belongs to the game: it has no monetary value and cannot be bought, sold, traded outside the game or refunded.
Bolts are earned in races; the capsule machine and crates give random items, for bolts only, never for real money.
Voltane is in development: tracks, cars, rules, prices in bolts and game balance may change to keep the game fair and fun.
07 Availability
Voltane is provided as is, in a version still in development. The publisher makes every effort to keep it online, but guarantees neither permanent availability nor the absence of bugs: maintenance, outages and updates may interrupt it.
08 Ownership of the game
The game, its code, its cars, its tracks, its visuals and its sounds belong to the publisher. You have the right to play it, for your personal, non-commercial use, from the official website.
Copying, hosting elsewhere, redistributing, decompiling or extracting all or part of the game (code, models, textures, sounds), or embedding it in another website, is prohibited without written permission. Videos and screenshots of your gameplay are welcome.
09 Liability
The publisher is liable for direct damage caused by a breach of these terms, within the limits set by law. The publisher is not liable for what drivers post themselves, nor for an interruption caused by a service provider, the network or force majeure.
10 Changes
These terms may change as the game evolves. The date at the top of the page shows the latest version; a significant change is announced in the game or by email before it applies. Continuing to play afterwards means accepting it; otherwise, you can delete your account.
11 The shop
The shop sells digital content delivered to the Voltane account of the buyer, or of the driver they give it to: the Founder Pack (a numbered Founder badge, the driver name on the Founders’ wall, and in the game the Founder Blue paint, the Founder flames and the Founder sticker) and support “batteries” (the Supporter tag). None of them gives any advantage in races. The Founder Pack can only be bought once per account.
Prices are in euros, VAT not applicable (article 293 B of the CGI, the French General Tax Code). Payment is made on Stripe’s secure page; the publisher never sees or keeps card details.
The order is confirmed on the page you return to after paying, and by email. The content is delivered to the account at once; the Founder Pack’s items are worn from the Style screen in the garage.
12 Right of withdrawal
The shop’s items are digital content supplied without any tangible medium and delivered immediately. Before paying, the buyer expressly requests this immediate performance and waives their right of withdrawal (article L221-28, 13° of the Code de la consommation, the French Consumer Code); the date of this consent is recorded with the order.
An order that was not delivered, or paid for twice by mistake, is refunded: write to [email protected] with the order number.
13 Legal guarantee of conformity
The consumer has two years from the supply of the digital content or digital service to obtain the implementation of the legal guarantee of conformity if a lack of conformity appears. For one year from the date of supply, the consumer only has to prove the existence of the lack of conformity, not the date on which it appeared. The legal guarantee of conformity entails the obligation to supply all the updates needed to keep the digital content or digital service in conformity. The legal guarantee of conformity entitles the consumer to have the digital content or digital service brought into conformity without undue delay following their request, free of charge and without significant inconvenience to them. The consumer may obtain a price reduction while keeping the digital content or digital service, or may terminate the contract and be refunded in full in return for giving up the digital content or digital service, if:1° The trader refuses to bring the digital content or digital service into conformity;2° Bringing the digital content or digital service into conformity is unjustifiably delayed;3° The digital content or digital service cannot be brought into conformity without costs being imposed on the consumer;4° Bringing the digital content or digital service into conformity causes significant inconvenience to the consumer;5° The lack of conformity of the digital content or digital service persists despite the trader’s unsuccessful attempt to bring it into conformity. The consumer is also entitled to a price reduction or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination of the contract. The consumer is then not required to ask first for the digital content or digital service to be brought into conformity.Where the lack of conformity is minor, the consumer is entitled to cancel the contract only if the contract does not provide for the payment of a price.Any period during which the digital content or digital service is unavailable while it is being brought back into conformity suspends the remaining period of the guarantee until the digital content or digital service is supplied in conformity again. The rights mentioned above result from the application of articles L. 224-25-1 to L. 224-25-31 of the Consumer Code.A trader who in bad faith obstructs the implementation of the legal guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of average annual turnover (article L. 242-18-1 of the Consumer Code). The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for two years from the discovery of the defect. This guarantee entitles the consumer to a price reduction if the digital content or digital service is kept, or to a full refund in return for giving up the digital content or digital service.
The law requires this box word for word, in French (article D. 211-3 of the Consumer Code). The English above is a translation for your information; the official wording is the French text below.
14 Complaints and mediation
Any complaint: [email protected], answered within 7 days.
If a dispute remains unresolved, the consumer may refer it, free of charge, to the médiateur de la consommation (consumer mediator): [to be completed: name, address and website of the mediator the publisher has signed up with].
15 Governing law
These terms are governed by French law. Failing an amicable settlement, the dispute is brought before the competent courts; the consumer keeps the right to bring it before the court for their place of residence.
